Snappy Occasions Event Photo Booth Terms of Services
Snappy Occasions, a company registered in Scotland, with its principal place of business in Scotland, hereinafter referred to as the "Photo Booth Provider," and
Snappy Occasions, referred to as "Company," with its terms outlined below.
1. Event Details:
The Customer agrees to hire Snappy Occasions for the provision of event photo booth services at the event scheduled for [Event Date] at [Event Venue]. The specific details of the services are outlined in the attached Schedule A.
2. Booking and Payment:
a. To secure the booking, the Customer shall pay a non-refundable deposit of £100 to Snappy Occasions upon signing this Agreement.
b. The remaining balance for Snappy Occasions' services is due in full no later than 14 days before the scheduled event date. Failure to make the full payment by the specified date may result in the cancellation of services by Snappy Occasions.
3. Cancellation and Termination During Event:
a. In the event of cancellation by the Customer:
i. If the cancellation occurs more than 14 days before the scheduled event date, the Customer will forfeit the £100 deposit to Snappy Occasions and any payment made to Snappy Occasions.
ii. If the cancellation occurs within 14 days of the scheduled event date, the Customer shall be liable for the full contract amount to Snappy Occasions.
b. Termination During Event:
i. Snappy Occasions reserves the right to terminate services during the event if staff feel that there is a risk of danger to themselves or the equipment due to aggressive behaviour, intentional damage to props or equipment, or any other circumstances that pose a threat.
ii. In the event of termination under this clause, the Customer shall not be entitled to any refund, and Snappy Occasions shall not be liable for any further performance of services.
c. Rescheduling:
i. Rescheduling may be considered at the discretion of Snappy Occasions, subject to availability.
ii. Any rescheduled dates must be agreed upon by all parties and may be subject to additional charges.
4. Access and Requirements:
a. The Customer agrees to provide:
i. Access to a power outlet for the photo booth equipment.
ii. Access to a reliable Wi-Fi connection for the duration of the event.
iii. Access to the venue and setup area up to an hour and a half prior to booking time.
b. The Customer agrees to ensure that a minimum space of 8ft x 8ft (x8f if backdrop is included in service) is made available for the photo booth setup.
c. When applicable, for events involving backdrop rental, the Customer agrees to ensure a ceiling height above 8ft.
5. Meal Provision:
a. If the photo booth services extend beyond 3 hours and there is a meal being served during the event, the Customer agrees to provide a meal to the attendant(s) from Snappy Occasions during the event.
6. Media Usage for Marketing:
a. The Customer hereby grants Snappy Occasions the right to use any media, including photographs and videos taken during the event, for marketing and promotional purposes. This may include, but is not limited to, the company's website, social media platforms, and promotional materials.
b. Snappy Occasions agrees to use such media in a professional and tasteful manner.
7. Customer Liability for Damage:
a. The Customer is responsible for any damage caused to Snappy Occasions' equipment or property during the event.
b. In the event of damage or theft, the Customer agrees to cover all costs associated with the repair or replacement of damaged equipment or property.
c. The Customer agrees to indemnify and hold harmless Snappy Occasions from any liability for damage caused by the Customer or their guests.
8. Supervision of Children:
a. All children under the age of 16 must be supervised by an adult over the age of 21 during the event.
9. Face Painting Limitation:
a. Children under the age of 3 are not eligible for face painting services.
b. It is the responsibility of the parent/guardian to make the attendant aware of any skin conditions that may affect face painting.
10. Force Majeure:
If Snappy Occasions is unable to perform its obligations under this Agreement due to circumstances beyond its control, such as but not limited to acts of God, government regulations, natural disasters, or other force majeure events, Snappy Occasions shall promptly notify the Customer and take reasonable steps to resume performance as soon as possible. In such cases, Snappy Occasions shall not be held in breach of this Agreement, and the obligations under this Agreement may be extended as necessary.
11. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of Scotland. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the Scottish courts.
